William Bennett – Jonathan Peter Deed 9 Jan 1847


This deed is between William Bennett and Rebecca (Pittman) Bennett, his wife and a Jonathan Peter, in 1847 in Orange County, Indiana. William is my 4th great grandfather.

This indenture made and entered into this 9th day of January in the year of our Lord one thousand eight hundred and forty seven between William Bennett and Rebecca Bennett his wife of the county of Orange and State of Indiana of the first part and Jonathan Peter of the County and State aforesaid of the second part  Witnesseth that the said William Bennett for and in consideration of the sum of seven dollars to him in hand paid the receipt whereof he doth hereby acknowledge hath granted bargained sold conveyed and confirmed and doth by these presents grant bargain sell convey and confirm unto the said Jonathan Peter his heirs and assigns forever a certain tract or parcel of land in the county of Orange aforesaid it being five acres of the North East quarter of the South West quarter of Section twenty four in Town one South of Range one West commencing at the South East corner of said quarter quarter running  due West ten rods thence North Eighty rods thence East ten rods thence south eighty rods to the place of beginning of the lands directed to be sold at Vincennes by the United States and estimated to contain five acres Together with all the appurtenances thereunto belonging and the revisions remainders and profits thereof and all the estate Title and interest of the said William Bennett in and to the same to have and to hold the premises aforesaid with all the appurtenances to the only proper use benefit and behoof of the said Jonathan Peter his heirs and assigns forever and the said William Bennett for himself his heirs executors and administrators doth covenant and agree to and with the said Jonathan Peter his heirs and assigns that the said William Bennett is lawfully seized in fee of the premises aforesaid that they are free from all incumbrance and that he has good right to sell and convey the same in manner and form aforesaid and Jonathan that he and his heirs and executors and administrators shall and will warrant and forever defend the said premises to the said Jonathan Peter his heirs and assigns against the lawful claims of himself and his heirs and assigns and also against the lawful claims or claims of all and every other person or persons whatsoever and the said Rebecca Bennett the wife of the said William Bennett doth hereby relinquish all her right and titles of dower of and in the premises aforesaid in Witness whereof the said William Bennett and Rebecca Bennett his wife have hereunto set their hands and seals the day and year above written sign sealed and delivered in presence of witnesses Harrison Pittman and Enoch Bennett.

This day personally came before me Harrison Pittman a Justice of the Peace in and for county aforesaid the written named William Bennett and Rebecca Bennett his wife and acknowledged the written deed of conveyance to be of their own proper act and deed for the use and purposes herein specified and  his said wife being seperate and apart and without the hearing of her said husband examined says she voluntarily relinquishes her right of dower to the within named premises without any coercion or compulsion by her said husband given under my hand and seal this January the 9th day 1847

Note that besides the conveyance of land, this deed also reveals that great grand Uncle Harrison Pittman is a Justice of the Peace for Orange County in 1847 and 1848. He is Rebecca Bennett’s brother, son of James Pittman and Rachel McGrew.
