Settlement Deed for Joseph Elledge Heirs Orange Co Indiana


This deed is to settle the estate of Joseph Elledge in which his children, all named, sell their portion of the land he left to John, their brother for $500. Since this is a simple sale of deed, and not a court decree, it tells us that Joseph may have left a will, if not there may be a court administration. Since it does not directly name their relationship to Joseph or each other, except as spouses, (or even mention Joseph) it is not proof of the family relationships but it is strong circumstantial evidence. Also it does give us several marriage proofs for the siblings, if their actual marriage records cannot be located.

This indenture witnesseth that Joannis Collins, and her husband O.J. Collins, Alfred Elledge and his wife, Anna Elledge, Catherine Purkhiser, and her husband J. H. Purkhiser, Minnie E. Young, and her husband R. J. Young, Saranda E. Tarr, and her husband Morgan Tarr, Lucinda Earley and her husband David Earley of Orange County in the State of Indiana convey and warrant to John W. Elledge of Orange County in the State of Indiana for the sum of Five hundred dollars the receipt of which is hereby acknowledged the following Real Estate in Orange County in the state of Indiana, to wit: A part of the north east quarter of the south east quarter of section four (4) Township One (1) north, Range two (2) west, described as follows to wit: Beginning at the south east corner of said quarter quarter and thence run north twenty six and twenty four hundredths (26 + 24/100) rods thence run  west thirty one and seventy six hundredths (31 + 76/100) rods thence thence run south one hundred (100) feet to the place of beginning proper, thence run west twenty and three fourths (20+3/4) rods, thence run north sixty (60) feet thence run west nine and nine tenths (9+9/10) feet, thence run south one hundred sixty (160) feet thence run east twenty one and thirty five hundredths (21 + 35/100) rods, thence run north one hundred (100) feet to the place of beginning. In witness whereof, the said Joanis Collins and her husband O.J. Collins, Alfred Elledge and his wife, Anna Elledge, Catharine Purkhiser and her husband J.H. Purkhiser: Minnie E. Young, and her husband R. E. Young, Saranda E. Tarr, and her husband, Morgan Tarr, Lucinda Earley and her husband David Earley have hereunto set their hands and seals this twenty third day of May A.D. 1904.

Collins, Alfred Elledge and his wife Annie Elledge, Catharine Purkhiser and her husband James H. Purkhiser, Minnie E. Young and her husband Robert E. Young, Maranda E. Tarr and her husband James M. Tarr and Lucinda Earley and her husband David Earley and acknowledged the execution of the annexed deed. Witness my hand and Seal
